Switched on Insurance Coöperatief U.A., as Data Controller, are committed to protecting and respecting your privacy in accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”), the Dutch Implementation Act of the GDPR, and other applicable local data protection laws in the countries where we operate.
This notice summarises how we collect, use, store and share your personal data when you purchase, use or enquire about our travel and gadget insurance products.

1. How we use your personal data

We use the personal data we hold about you for the purposes of providing insurance, handling claims and any other related purposes (this may include underwriting decisions made via automated means), for offering renewal, research or statistical purposes and to provide you with information, products or services that you request from us or which we feel may interest you. We will also use your data to safeguard against fraud and money laundering and to meet our general legal or regulatory obligations.

2. Special Categories of Data

Some of the personal information, such as information relating to health or criminal convictions, may be required by us for the specific purposes of underwriting or as part of the claims handling process. The provision of such data is conditional for us to be able to provide insurance or manage a claim. Such data will only be used for the specific purposes set out in our notice.

3. Legal grounds for processing data

We process your personal data on one or more of the following legal grounds: to perform an agreement for a financial product or service; to comply with a legal obligation, such as our duty of care during the term of a financial product arranged through our mediation or statutory data retention requirements; based on the explicit consent you have provided for specific purposes, which you may withdraw at any time; or for the protection of our legitimate business interests or those of a third party, including the proper execution of agreements with you and the maintenance or development of our customer relationship through direct marketing and/or marketing-related profiling.

4. Disclosure of your personal data

We disclose your personal data to third parties involved in providing products or services to us, or to service providers who perform services on our behalf. These include our group companies, affinity partners, brokers, agents, third party administrators, reinsurers, other insurance intermediaries, insurance reference bureaus, credit agencies, medical service providers, fraud detection agencies, loss adjusters, external law firms, external accountants and auditors, regulatory authorities, and as may be required by law.

5. International transfers of data

We may transfer your personal data to destinations outside the European Economic Area (“EEA”). Where we transfer your personal data outside of the EEA, We will ensure that it is treated securely and in accordance with the Legislation, such as:

  • The country has an EU adequacy decision, or
  • The use of European Commission Standard Contractual Clauses (SCCs), or
  • Other safeguards recognised under GDPR.

Under GDPR, you have the right to access a copy of the personal data we hold about you, request correction or deletion of inaccurate or unnecessary data, restrict or object to the processing of your data, receive your data in a portable format for transfer to another controller, withdraw consent for marketing communications.

You can also lodge a complaint with your local Data Protection Authority (in the Netherlands, the Autoriteit Persoonsgegevens, www.autoriteitpersoonsgegevens.nl).

8. Retention

We retain your personal data only as long as necessary for the purposes for which it was collected, usually for ten (10) years after the end of our business relationship, unless a longer period is required for legal, regulatory, or dispute resolution purposes.
